Placement Point Solutions (“PlacementPS”, “Company”, “We”, “Us”, or “Our”) is a professional training and career development organization engaged in providing industry-oriented training, hands-on learning, mentorship, internship facilitation, and placement assistance services across emerging technologies including but not limited to Artificial Intelligence & Machine Learning, Cloud & DevOps, Data Analytics, Full Stack Development, SAP, and Software Testing.

These Terms and Conditions (“Terms”) govern the relationship between PlacementPS and the candidate/student (“Candidate”, “You”, “Your”) enrolling in any course, training program, internship facilitation, placement assistance, or allied services offered by the Company.

By enrolling, accessing training, or making payment, the Candidate expressly acknowledges and agrees to be bound by these Terms.

1. SCOPE AND PURPOSE:

1. These Terms define the rights, responsibilities, limitations, disclaimers, and obligations governing training, internship facilitation, and placement assistance services provided by PlacementPS.

2. The services offered are purely educational and facilitative in nature and shall not be construed as a guarantee of employment, job placement, or income generation.

3. The primary purpose is to deliver industry-relevant training, enhance practical skills, and provide facilitation support for internships and placement opportunities, subject to the Candidate’s merit, performance, skills, discipline, and market conditions.

2. PAYMENT TERMS AND REFUND POLICY:

1. All fees paid are strictly non-refundable under any circumstances, including but not limited to:

  • Course discontinuation
  • Non-attendance
  • Medical reasons
  • Personal reasons
  • Course dissatisfaction
  • Non-selection in interviews
  • Delay or non-receipt of placement or internship

2. Once payment is made, it shall not be refunded, transferred, adjusted, or credited under any circumstances.

3. Payments made are non-transferable to any other person, candidate, course, batch, or service.

4. The entire course fee must be paid in full once training commences, unless a written installment arrangement has been formally approved by the Company.

5. Any delay in payment shall attract late fees, penalty charges, or suspension of training, at the sole discretion of the Company.

6. Any discount, concession, or special pricing extended to a Candidate is strictly confidential, and disclosure or misuse shall invite penalty and disciplinary action.

3. SCOPE OF TRAINING:

1. PlacementPS provides industry-oriented, practical, and skill-based training, including:

  • Instructor-led sessions
  • Hands-on labs
  • Live projects
  • Case studies
  • Career mentoring

2. The training does not include any proprietary, licensed, pirated, or third-party commercial software, unless expressly mentioned in writing.

3. All training materials, content, modules, and sessions are designed exclusively for academic and learning purposes only.

4. PlacementPS does not provide any original or pirated licensed software to candidates.

5. Training delivery mode may be offline, online, hybrid, recorded, live, or blended, as determined by the Company

4. PLACEMENTS AND INTERNSHIPS:

1. PlacementPS provides 100% facilitation support for placement and internship opportunities, which includes:

  • Resume building
  • Interview preparation
  • Career guidance
  • Industry referrals
  • Internship and interview coordination

2. Placement and internship opportunities are facilitative services only and not guaranteed outcomes.

3. PlacementPS does not guarantee any job, internship, salary package, employment tenure, job role, company selection, or career progression.

4. Hiring decisions are solely based on:

  • Candidate’s skills
  • Performance
  • Interview evaluation
  • Company hiring policies
  • Market demand
  • Industry requirements

5. Many organizations prefer freshers initially for internships, and placement outcomes depend on company hiring criteria, which is beyond the control of PlacementPS.

6. The Candidate acknowledges that employment is talent-based, and final hiring authority rests exclusively with recruiting organizations.

5. RESPONSIBILITIES OF PLACEMENT POINT SOLUTIONS:

1. To provide structured training programs delivered by experienced industry trainers.

2. To offer hands-on learning and project exposure.

3. To provide career guidance, mentorship, and placement facilitation support.

4. To conduct mock interviews, resume reviews, and employability enhancement sessions.

5. To issue training certificates upon successful course completion.

6. RESPONSIBILITIES OF CANDIDATES:

1. To maintain regular attendance, discipline, professionalism, and academic integrity.

2. To actively participate in training, projects, assessments, and interviews.

3. To develop required technical and soft skills through continuous effort.

4. To comply with institute policies, code of conduct, and operational guidelines.

5. To maintain confidentiality of internal training materials and company processes.

6. To refrain from defamatory, misleading, or false statements against the Company.

7. REPRESENTATIONS AND WARRANTIES:

1. PlacementPS represents that it shall provide professional training services with reasonable skill and care.

2. The Company’s representations and warranties shall strictly cease upon issuance of the course completion certificate.

3. No representation is made regarding:

  • Guaranteed placement
  • Guaranteed internship
  • Guaranteed salary
  • Guaranteed job role

4. The Candidate represents that all information provided is true, correct, and complete, and acknowledges responsibility for skill development and employability outcomes.

8. INDEMNITY AND LIMITATION OF LIABILITY:

1. The Candidate agrees to indemnify and hold harmless PlacementPS, its directors, employees, trainers, and affiliates from any claims, losses, damages, liabilities, or legal proceedings arising from:

  • Candidate misconduct
  • Misrepresentation
  • Breach of these Terms
  • Violation of law
  • Defamation

2. PlacementPS shall not be liable for any direct, indirect, incidental, consequential, or economic losses, including loss of employment opportunity, income, career progression, or reputation.

3. Under no circumstances shall the Company’s liability exceed the course fee paid by the Candidate.

9. CODE OF CONDUCT:

1. Candidates shall maintain discipline, professionalism, and decorum inside the premises.

2. Usage of pen drives, external storage devices, or unauthorized equipment is strictly prohibited.

3. Any damage caused to infrastructure shall be fully compensated by the Candidate.

4. Misconduct, harassment, misbehavior, or policy violations may result in immediate suspension or termination from the program without refund.

10. CONFIDENTIALITY:

1. Candidates shall maintain strict confidentiality of training content, materials, methodologies, software access, and internal systems.

2. Unauthorized sharing, copying, reproduction, or commercial exploitation is strictly prohibited.

11. INTELLECTUAL PROPERTY RIGHTS:

1. All training content, study material, presentations, videos, documents, and resources are the exclusive intellectual property of PlacementPS.

2. No part may be copied, reproduced, distributed, transmitted, or used for commercial purposes without prior written consent.

12. NON-DISPARAGEMENT:

1. The Candidate agrees not to make any false, misleading, defamatory, or disparaging statements about the Company, its trainers, staff, affiliates, or services.

2. This obligation continues even after completion, withdrawal, or termination of training.

3. Any act of defamation shall invite civil and criminal legal proceedings under applicable laws.

13. PRIVACY AND DATA PROTECTION:

1. Candidate data shall be used solely for:

  • Training administration
  • Placement facilitation
  • Internship coordination
  • Legal and regulatory compliance

2. PlacementPS shall take reasonable security measures to protect personal data.

14. TERM AND TERMINATION:

1. These Terms shall remain effective from enrollment until course completion.

2. PlacementPS reserves the right to terminate enrollment without refund in case of:

  • Misconduct
  • Policy violation
  • Non-payment
  • Indiscipline
  • Legal non-compliance

15. GOVERNING LAW AND DISPUTE RESOLUTION:

1. These Terms shall be governed by and construed in accordance with the laws of India.

2. Any disputes, claims, or differences arising out of or in connection with these Terms shall be resolved in the following manner:

  • Negotiation: Parties shall attempt to resolve the dispute amicably through mutual discussions.
  • Mediation: If unresolved, Parties may refer the dispute to a mutually agreed neutral mediator in accordance with The Mediation Act, 2023.
  • Arbitration: Unresolved disputes may be submitted to arbitration under the Arbitration and Conciliation Act, 1996, in Chennai, Tamil Nadu, and the arbitrator’s decision shall be final and binding.
  • Court Jurisdiction: Parties may approach courts in Chennai, Tamil Nadu, for enforcement of rights, interim relief, or any matter not covered by arbitration.

3. Both Parties shall cooperate in good faith to resolve disputes and minimize delays.

16. MISCELLANEOUS:

1. Force Majeure:

The Company shall not be liable for delays or failures caused by events beyond reasonable control including acts of God, natural disasters, pandemics, government restrictions, internet outages, or technical failures.

2. Amendments:

PlacementPS reserves the right to modify these Terms at any time without prior notice. Updated terms shall be binding upon publication.

3. Severability:

If any provision is held invalid, the remaining provisions shall continue in full force.

4. Waiver:

Failure to enforce any provision shall not constitute waiver of future enforcement.
